1. Acceptance of Terms

By downloading, installing, or using the MergeMark desktop application ("Software"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Software.

2. Beta Software

MergeMark is currently distributed as Beta Software (e.g., version 0.9.0). This means the Software is provided "as is" and "as available," without any warranties of any kind, either express or implied.

We do not guarantee that the Software will be error-free or uninterrupted, or that any defects will be corrected. You use the Beta Software at your own risk.

3. License & Copyright

The Software, its UI, algorithms, and associated website content are proprietary. You may view the code for educational and portfolio evaluation purposes. However, you may not copy, modify, distribute, or use this code (or any of its assets) for commercial or non-commercial purposes without explicit written permission.

4. Third-Party APIs (BYOK)

MergeMark provides a "Bring Your Own Key" (BYOK) functionality that allows you to interface with third-party AI APIs (such as OpenAI or Anthropic). You are solely responsible for compliance with the terms and conditions of any third-party services you connect to MergeMark, as well as any fees incurred through your usage of those APIs.

5. Limitation of Liability

To the maximum extent permitted by law, MergeMark shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from your access to or use of or inability to access or use the Software.
